TERMS AND CONDITIONS – MAISON MENLO

2. Applicability
2.1 These terms apply to all offers and agreements.

2.2 By placing an order, the customer agrees to these terms.

2.3 Deviations are only valid if confirmed in writing by Maison Menlo.
3. Formation of the agreement
3.1 All offers are non-binding.

3.2 Maison Menlo may refuse or cancel orders in case of, among others:
  • (suspicion of) fraud
  • pricing or system errors
  • stock issues
  • incomplete or incorrect data
  • technical failures
3.3 The agreement is concluded upon confirmation by Maison Menlo.
4. Prices
4.1 All prices are in euros including VAT, unless stated otherwise.

4.2 Obvious errors in price or product information are not binding for Maison Menlo.

4.3 Maison Menlo may correct errors or cancel orders.
5. Product information and expectations
5.1 Product information is displayed as accurately as possible.

5.2 Images are for illustrative purposes only.

5.3 Natural and production-related variations in color, finish, materials, light output, and dimensions may occur.

5.4 These variations do not constitute a defect as long as they fall within reasonable expectations.

5.5 Minor differences between product and image may occur due to lighting, screen settings, and production differences.
6. Electrical safety and use (IMPORTANT)
6.1 Products must be used within the specified technical values (including voltage, wattage, and compatibility).

6.2 Damage caused by improper use, incorrect connection, incorrect dimmers, or incompatible components is excluded from warranty.

6.3 Products are intended for use within EU standards (230V unless otherwise stated).

6.4 The customer is responsible for correct application and installation.
7. Payment
7.1 Orders must be paid in full in advance.

7.2 Maison Menlo may refuse payments in case of suspected misuse or fraud.

7.3 In case of chargebacks or payment disputes, Maison Menlo may provide evidence (such as tracking, order details, and communication).

7.4 Unjustified chargebacks may be contested and may lead to additional costs where legally permitted.
8. Delivery
8.1 Delivery times are indicative.

8.2 Delays do not entitle the customer to compensation or cancellation, unless legally required.

8.3 Maison Menlo is not liable for delays caused by third parties (transport/customs).

8.4 The customer is responsible for correct address details.

8.5 If delivery fails due to incorrect address, absence, or non-collection, additional costs may be charged.

8.6 Delivery is considered completed once the product has been offered or delivered to the specified address.
9. Inspection upon receipt
9.1 The customer is requested to inspect the product immediately upon receipt.

9.2 Visible damage or deviations must be reported within a reasonable time (preferably within 48 hours) with photos.

9.3 Timely reporting helps with processing through the carrier or supplier.

9.4 This clause does not affect statutory consumer rights.
10. Right of withdrawal
10.1 Consumers have a 14-day right of withdrawal.

10.2 During this period, the product may be evaluated as in a physical store.

10.3 Excessive use beyond what is necessary for evaluation may result in depreciation.

10.4 The return procedure is stated on the returns page.
11. Returns and depreciation
11.1 Returns must be complete and carefully packaged.

11.2 In case of damage, use, or missing parts, depreciation may be applied within legal limits.
12. Warranty
12.1 Legal warranty always applies.

12.2 Warranty is void in case of:
  • improper use
  • incorrect installation
  • use of incorrect light sources or dimmers
  • modifications by third parties
  • normal wear and tear
13. Installation
13.1 Maison Menlo does not perform installation or assembly.

13.2 Installation must be carried out by a qualified professional.

13.3 Maison Menlo is not liable for damage caused by installation or assembly by third parties.
14. International delivery (EU)
14.1 Maison Menlo delivers to countries including Germany, France, and Belgium.

14.2 Customs duties, import duties, and local taxes are the responsibility of the customer unless stated otherwise.

14.3 Maison Menlo is not liable for delays in international shipping or customs.
15. Delivery, risk and transport (ADDITIONAL)
15.1 Risk transfers to the customer upon delivery at the specified address.

15.2 Maison Menlo is not liable for loss or damage after delivery by third parties.

15.3 Transport claims are assessed based on available tracking and delivery information.
16. Electrical installation and damage (RISK POINTS 1 & 2)
16.1 Damage caused by incorrect connection, wrong voltage, incompatible components, or improper installation is excluded from liability.

16.2 Issues caused by installation errors, including by third parties, are excluded from warranty and responsibility of Maison Menlo.

16.3 The customer is responsible for correct technical application of the product.
17. Liability
17.1 Liability is limited to direct damage and a maximum of the purchase amount.

17.2 Maison Menlo is not liable for indirect damages such as consequential damage, loss of profit, or reputational damage.

17.3 Exclusion does not apply in case of intent or gross negligence.
18. Force majeure
18.1 Force majeure includes, among others: disruptions, strikes, transport issues, pandemics, cyberattacks, and government measures.

18.2 During force majeure, obligations may be suspended or terminated without compensation.
19. Cancellation
19.1 Maison Menlo may cancel orders in case of, among others, errors, fraud, or stock issues.

19.2 Paid amounts will be refunded.
20. Payment disputes and chargebacks
20.1 In case of disputes, Maison Menlo may provide evidence such as tracking, order data, and communication.

20.2 Unjustified chargebacks may be contested and may result in additional costs where legally permitted.

20.3 Customers are requested to contact us first before initiating a chargeback.
21. Evidence and product claims (RISK POINT 5)
21.1 Maison Menlo may request evidence such as photos or videos for claims.

21.2 Lack of reasonable evidence may affect the assessment.

21.3 Claims are assessed based on reasonableness and available information.
22. Complaints (RISK POINT 4)
22.1 Complaints can be submitted via info@maisonmenlo.com.

22.2 Response time is usually within 5 working days.

22.3 If more time is needed, the customer will be informed.

22.4 Complaints do not suspend payment obligations.
23. Intellectual property
23.1 All content remains the property of Lamp ’n Launch.

23.2 Without permission, it is prohibited to copy, use, or scrape content, including for AI training.
24. Return abuse
24.1 The right of return may be used in accordance with the law.

24.2 In case of structural abuse, Maison Menlo may refuse future orders, where legally permitted.
25. Disputes
25.1 Parties will first attempt to resolve disputes amicably.

25.2 If this fails, the competent court in the Netherlands has jurisdiction.

25.3 Dutch law applies.
26. Final provision
If any provision is invalid, the remaining provisions remain fully valid.
